Terms of Use for AJIRA MARKET

1. Acceptance of Terms

By accessing or using the AJIRA MARKET (the "System"), you agree to comply with and be bound by these Terms of Use (the "Terms"). If you do not agree with these Terms, do not use the System.

2. Eligibility

You must be at least 18 years old to use the System. By using the System, you represent that you are of legal age and have the authority to enter into a binding agreement. If you are accessing the System on behalf of an organization, you confirm that you have the authority to bind that organization.

3. Account Registration and Security

To access certain features of the System, such as applying for jobs or posting job listings, you may need to create an account. By creating an account, you agree to:

• Provide accurate, current, and complete information during the registration process.
• Maintain the security of your account credentials and promptly notify us of any unauthorized access or use.
• Be responsible for all activities under your account, whether or not you authorized such activities.

4. Use of the System

You agree to use the System only for lawful purposes and in accordance with these Terms. Specifically, you agree not to:

• Post, upload, or transmit content that is unlawful, harmful, abusive, defamatory, obscene, or violates the rights of others.
• Use the System to engage in any fraudulent, illegal, or discriminatory activity.
• Misuse the System by interfering with its functionality, attempting to access data you are not authorized to access, or uploading viruses or other harmful components.

5. User Responsibilities

• For Job Seekers: You agree to provide accurate, truthful, and up-to-date information in your job applications, resumes, and any other personal data submitted through the System. You are solely responsible for the information you share with potential employers.
• For Employers and Recruiters: You agree to post job listings that are truthful, accurate, and compliant with applicable laws, including labor and discrimination laws. You agree to treat applicants fairly and transparently throughout the hiring process.

6. Prohibited Content and Activities

The following are prohibited on the System:

• Posting content that is illegal, offensive, or discriminatory based on race, religion, gender, disability, or any other protected status.
• Engaging in harassment or any behavior that disrupts the experience of other users.
• Sharing misleading or fraudulent job opportunities.
• Attempting to collect, harvest, or scrape personal data from other users.

7. Intellectual Property

The System, including its software, content, design, and branding, is owned by RELIANCE SOLUTIONS AND TECHNOLOGY (T) LTD or its licensors and is protected by intellectual property laws. You do not acquire any ownership rights to the System or its content by using the System. You may only use the System for personal or professional purposes as outlined in these Terms.

8. Privacy Policy

Your use of the System is governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the System, you consent to the collection and processing of your personal data as described in our Privacy Policy.

9. Fees and Payment

Some features of the System may require payment, such as posting job listings or accessing premium job-seeker services. All fees will be clearly communicated before you complete any purchase. You agree to pay all fees associated with your use of the System and acknowledge that these fees are non-refundable, unless otherwise specified.

10. Disclaimers

• No Guarantee of Employment or Job Offers: The System is a platform that connects job seekers with employers. We do not guarantee that you will find a job or receive a job offer. Likewise, we do not guarantee that an employer will hire you through the System.
• No Guarantee of Job Listing Quality: While we strive to ensure that job listings are legitimate and accurate, we make no guarantees regarding the quality, authenticity, or legality of any job posted through the System.
• No Warranty: The System is provided "as is" and "as available," without warranties of any kind, either express or implied. We do not guarantee that the System will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the fullest extent permitted by law, RELIANCE SOLUTIONS AND TECHNOLOGY (T) LTD and its affiliates will not be liable for any indirect, incidental, special, or consequential damages arising from your use or inability to use the System, including but not limited to, loss of data, loss of profits, or business interruption.

12. Indemnification

You agree to indemnify and hold harmless RELIANCE SOLUTIONS AND TECHNOLOGY (T) LTD and its employees, directors, affiliates, and partners from any claims, losses, damages, liabilities, and expenses (including attorney’s fees) arising out of or related to your use of the System or your violation of these Terms.

13. Termination and Suspension of Accounts

We reserve the right to suspend or terminate your access to the System at any time, without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your access to the System will be revoked, and you must cease using the System immediately.

14. Changes to the Terms of Use

We may update or modify these Terms at any time. Changes will be posted on this page with a revised "Last Updated" date. By continuing to use the System after changes are posted, you agree to the updated Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of THE UNITED REPUBLIC OF TANZANIA, without regard to its conflict of law provisions. Any disputes arising out of or related to these Terms will be resolved in the courts of Jurisdiction of THE UNITED REPUBLIC OF TANZANIA.
